Terms of Service

Openwing is operated by an individual (sole proprietor) based in Mumbai, Maharashtra, India. These terms are an agreement between you and that individual, not a company. Contact: tulipaimodel47@gmail.com.

By creating an account, you agree to these terms, the Privacy Policy, and the Refund Policy. If you do not agree, please do not create an account or use the service.

1. What the service does

You describe an idea or upload a reference image, and Openwing uses third-party AI models to generate images or short clips for you. You never write the underlying prompt sent to the AI model; the service writes it on your behalf.

2. Credits

Generations and edits are paid for with credits. Chat usage is metered separately and never costs credits: subscription plans include chat usage and a number of free resets. New accounts receive a small number of free credits to try the service, and free accounts also have a lifetime limit on chat messages and preview generations, separate from the credit balance. These do not represent a right to future free credits or usage, and the limits may change.

The free allowance is per person, not per account. We recognise repeat signups, including through inbox tricks such as Gmail's dots or +tags that route to the same mailbox, and treat them as the same person for the purpose of this allowance.

Credit costs can change. The cost of an action in credits, and the price of credits themselves, may change at any time. Where practical, we will give at least 7 days notice by email before a price increase takes effect. Credits already in your account are not devalued by a price change; they still hold the value they were purchased at, in terms of the actions available when they were bought.

If a generation fails for a reason that is not your fault, the credits held for that job are returned to your balance automatically. This is separate from a monetary refund; see the Refund Policy for what that covers.

3. Subscriptions

Paid plans are monthly subscriptions, not one-time purchases. When you subscribe, you authorise us to charge the plan price automatically every month until you cancel. You are charged each month regardless of usage: the fee covers your access to the plan for that billing cycle, not the credits you spend within it.

Each billing cycle refills your credits to the plan's full amount and resets your chat quota for the new cycle. Credits you do not use by the end of the cycle expire — there is no rollover to the next month. Your chat quota likewise resets at the start of each cycle.

You can cancel at any time from your account panel. Cancellation takes effect at the end of the current billing period: your plan stays active, with its credits and chat quota, until then, and you are not charged again. If a payment fails, then at the end of the billing period your credits and chat allowance expire and your account returns to the free tier.

4. Your content

You are solely responsible for anything you upload or type into Openwing, including reference images. You confirm that you have the right to upload and use that content, and that it does not infringe anyone else's copyright, trademark, or other rights. Uploading content you do not have the rights to is a breach of these terms and may result in your account being suspended.

You keep ownership of images and clips you generate through the service, subject to the terms of the underlying AI providers we use to produce them. We do not claim ownership of your generated output.

We may remove content or suspend an account that we reasonably believe violates these terms, produces content depicting real people without consent for deceptive purposes, or is illegal, without advance notice.

Copyright complaints — notice and takedown. If you believe material on the service infringes your copyright, email tulipaimodel47@gmail.com with (1) identification of the copyrighted work, (2) the URL or location of the allegedly infringing material on the service, (3) your name and contact details, (4) a statement that you have a good-faith belief the use is not authorised by the copyright owner, and (5) a statement, made under penalty of perjury, that the information in the notice is accurate and you are authorised to act for the copyright owner. We review valid notices promptly and remove or disable access to material we reasonably believe infringes. Accounts that repeatedly upload infringing content are terminated.

5. Acceptable use

• No content that is illegal, exploitative, or infringes another person's rights.
• No attempting to bypass credit limits, rate limits, or security controls.
• No creating multiple accounts, including through email aliases, to obtain more free usage than the allowance described above.
• No reverse engineering the prompts, pipeline, or systems behind the service.
• No automated or bulk use beyond what the interface itself allows.

6. Third-party AI providers

Generating a reply or an image means your description, and any reference image you attach, is sent to a third-party AI provider to produce the result. See the Privacy Policy for which providers and what that means for your data.

As a user in India, your personal data is also handled under India's Digital Personal Data Protection Act, 2023. What that means in practice, including how to raise a complaint and how long we take to respond, is set out in the Privacy Policy, not repeated here.

7. No warranty

The service is provided "as is". AI generated output can be wrong, low quality, or fail to match what was asked for. We do not guarantee that any particular generation will succeed or meet your expectations.

8. Limitation of liability

To the fullest extent permitted by law, the operator's total liability to you for any claim arising from your use of the service is limited to the amount you paid in the 3 months before the claim arose. The operator is not liable for indirect, incidental, or consequential damages, including lost profits or lost data.

9. Taxes

Prices shown exclude applicable taxes, including GST where it applies. Any tax owed on a purchase is added at checkout or is your responsibility to account for, as required by law in your jurisdiction.

10. Termination

You may stop using the service and delete your account at any time. We may suspend or terminate an account that violates these terms. Unused credits are handled as described in the Refund Policy.

11. Changes to these terms

We may update these terms as the service changes. Material changes will be reflected by a new "last updated" date above, and where practical we will notify account holders by email. Continuing to use the service after a change means you accept the updated terms.

12. Governing law

These terms are governed by the laws of India.
